§01 Statutory positioning

'Digital Product Passport service provider' means a natural or legal person authorised by an economic operator to process digital product passport information for the purposes of making it available to economic operators, customers, consumers, users and other relevant actors.

§04 Where the obligation sits

The regulatory obligation rests with the economic operator — the manufacturer, importer, authorised representative, or distributor who places the product on the EU market. EU Digital Passport Processor processes passport data on the operator's authorised instruction; it does not assume the operator's obligation. Operators retain accountability for the accuracy, completeness, and timeliness of submitted data, in line with the wording used by national competent authorities in adjacent reporting regimes.
