1. Agreement
By creating an account or using EU Digital Passport Processor you agree to these terms. EU Digital Passport Processor is operated by Dynamic Systems Consulting Limited (Company No. 15569270, England and Wales), trading as EU Digital Passport Processor (“we”, “us”). “You” means the organisation that holds the account.
2. What we provide
Software and services for creating, hosting, registering and maintaining Digital Product Passports under Regulation (EU) 2023/1542 (the Battery Regulation) and Regulation (EU) 2024/1781 (ESPR), and an independent backup copy service. We act as a DPP service provider. Regulatory responsibility for each passport stays with the economic operator that places the product on the market; we move the work, not the liability.
3. Platform licence
On payment of the annual platform licence you receive a non-exclusive, non-transferable licence for your organisation to use the platform for the goods-group module or modules you have licensed, for the licence year. The licence covers your organisation’s users without limit and does not scale with the number of passports you create or activate. The licence year runs from the date of payment and renews for further years on payment of the then-published licence fee; we will notify you at least 30 days before renewal. If the licence is not renewed, the platform becomes read-only for your organisation: existing passports remain accessible and exportable for 90 days, and passport custody continues under section 5.
4. Per-passport charges
Activating a passport incurs the one-off activation fee for its battery category, invoiced monthly in arrears. Each passport that is live at your licence anniversary incurs passport custody for the following year, at the published rate for its category. Retired and superseded passports are not charged. There is no charge for amendments or registry submissions. Published rates apply to everyone; there are no volume tiers and no caps.
5. Passport custody and the independent backup copy
For every live passport we hold and serve the record for as long as your Article 77 duty runs: hosting, an encrypted backup copy held in the EU independently of the primary instance, retention for the full period the regulation requires, registry synchronisation and, where the category carries them, state-of-health updates. Custody is a service, not a licence. It survives non-renewal of the platform licence, insolvency, liquidation and cessation of trading of the operator, as Article 11 requires of a service provider, for as long as the corresponding custody fees are paid or, where they are not, for the retention period already paid for. Custody may be ended by you at any time; on ending it we deliver a complete export and retain the archived record for the remainder of the regulatory retention period.
6. Standalone custody service
Operators who host their own primary passports may buy the backup copy on its own. The annual custody service fee is charged per goods-group module, in advance; per-passport custody is charged per live passport per year. There is no activation fee. Section 5 applies in full. Whether one provider may supply both the primary passport and the independent backup is not yet settled by the DPP Service Provider delegated act; we will tell you plainly if that changes what we may offer you.
7. Demo accounts
Demo accounts are provided on request for evaluation and expire after their stated period. Demo data is deleted at expiry unless an extension has been requested and granted before then. No charges apply to demo accounts.
8. Your data
You own the data you submit. We process it to provide the services and hold it in the EU. On account closure we deliver a complete export on request within 30 days, without prejudice to any custody that continues under section 5.
9. Availability
We target 99.9% availability of the public passport viewer and the platform. Planned maintenance is notified in advance. We are not liable for losses caused by outages beyond our reasonable control.
10. Limitation of liability
Our total liability under these terms is limited to the licence, activation and custody fees you paid in the twelve months before the claim. We are not liable for regulatory penalties, customs delays or business losses arising from the use or non-use of the platform. Nothing limits liability that cannot be limited by law.
11. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
